Negligence and Breach of Duties

• Represented a government-owned company in a USDS5 billion claim against former auditors for negligence.
• Represented a government-owned company in a USD200 million claim against individual and foreign companies for knowing receipt and dishonest.
• Represented a company and its director in defending conspiracy and breach of duties claim by a corporation for a dispute over a judgment sum of RM35 million.
• Advising on matters connected with financial fraud and forgery to recover approximately RM6 million.
• Represented a joint venture company in claim against shareholder and directors for breach of fiduciary duties and conspiracy to injure.

Contractual Disputes

• Represented an airline company operating cargo aircraft service in a USD8 million lease agreement dispute with a foreign bank.
• Represented a public listed corporate shareholder in an Arbitration in a RMI2 billion joint venture dispute involving the construction of a major public transportation system.
• Represented a sugar products manufacturer against a vendor and client in a series of contractual disputes in the sum of RM2.9 million.
• Represented a major mobile telecommunications provider in various disputes with former distributors involving distributorship agreements.
• Represented an Australian F&B company in contractual dispute with its local business partner in relation to franchising and licensing issues.
• Represented a local bank in a dispute over the freezing of a joint fixed deposit account upon death of account holder.
• Represented a property development company in defending claim for refund of liquidated ascertained damages of RMI million by a contractor.

Companies Act

• Represented a joint venture company in opposing applications for leave to commence derivative actions commenced by a director under Sections 347 and 348 of Companies Act 2016.
• Represented a joint venture company in defending committal proceedings by a director arising out of enforcement of an order to inspect company’s accounting records given under Section 167 of Companies Act 1965.
• Represented a joint venture company in appealing against a director’s application to inspect accounting records under Section 167 of Companies Act 1965.

Intellectual Property

• Represented a public listed software development company and its subsidiaries in an action against companies and their directors for, inter alia,
  copyright infringement, conspiracy, breach of confidence, unlawful interference with trade and conversion.
• Represented a manufacturer of component parts, machinery and equipment, in an action against a company for patent infringement.
• Represented a structural engineering software developer in relation to the protection and enforcement of intellectual property rights including
  lodging criminal complaints and commencing civil suits against various parties for copyright infringement.

Arbitration

• Represented a Korean cosmetics and healthcare company in enforcing final award in an arbitration against a local bio-pharmaceuticals company and opposing the application to set aside the final award.
